Penalty for Non-Production of Documents

Any person whoever being required by or under the legal metrology act or the rules made thereunder to do the followings:

  • Summit returns,
  • Maintain any record of register, or
  • Being required by the director or

In case of omits or fails without any reasonable excuses, on the non-producing the above-mentioned documents the on the order and instruction of controller legal metrology to produce the documents for inspection and weighing or measures or any document, register or other record relating thereto, shall be punishable (Read Also: Appointment of Officers Under Legal Metrology)

  • With a fine which may extend to rupees 5000, and
  • For the second or subsequent offense with imprisonment for a term which may extend to one year, or
  • With both fine and imprisonment.

Penalty for use of Unverified Measures and Weights

Any person whoever sales, distributes, deliver or otherwise transfer or use any unverified weights or measures shall be punishable

  • With fine which shall not be less than ₹2000,
  • Fine which may extend to rupees 10,000, and
  • In case of second or subsequent offense the person or offender shall be punishable with imprisonment for a term which may extend to one year, or with both.

Penalty for sale/delivery commodities by non-standard weights or measures

Any person whoever sales or cause to be sold, deliver, or cause to be delivered, any commodity, article or thing by any means other than the standard legal metrology weights and measures or numbers shall be punishable with a fine:

  • Which shall not be less than rupees 2000, but
  • Which may extend to rupees 5000, and
  • In case of second or subsequent offense the offender shall be punished with the imprisonment for a term which shall not be less than three months but which may extend to one year, or
  • With both fine and imprisonment.

Penalty for Rendering Services by Non-standard Weights, Measures

Penalty for rendering services by non-standard weights or measures or number any person in the following situation:

  1. Whenever any person founds to be an offender for rendering or causes to be rendered, any service through
    • Means other than the weights or measures or numeration, or
    • In term of any weights and measures or number other than the standard weights and measures

  2. Offender shall be punished with a fine
    • Which shall not be less than rupees 2000, but
    • Which may extend to rupees 5000, and
    • For the second or subsequent office with imprisonment for a term which shall not be less than three months, but
    • May extend to one year, or
    • With both fine and imprisonment. 

Penalty for Selling of Non-Standard Packages

  1. Whoever manufactured, imports, sales, packs, distributes, deliver or otherwise transfer offer, possesses or exposes for sale, or cause to be sold, distributed, delivered or otherwise transferred, offered, possessed for sale of any pre packaged commodity which does not confirm to the declaration on the package as provide under the legal metrology act shall be punished
    • With a fine which may extend to 25,000, and
    • For the second or subsequent offense shall be punished with a fine which may extend to 50,000, and
    • For the subsequent offense with a fine which shall not be less than ₹50,000
    • Which may extend to rupees one Lac or
    • With the imprisonment for a term which may extend to one year or with both.
  2. Any manufacturer or Packer or importer of the commodity who causes to be manufactured, or packed, or imported any packaged commodity with error in net quantity as may be prescribed shall be punished
    • With fine which shall not be less than rupees 10,000
    • The same maybe extend to the rupees 50,000, and
    • For the 2nd and subsequent offense punishable with a fine which may extend to rupees one lac,
    • Imprisonment for a term which may extend to one year, or both.
